However, we receive calls from people who believed that, if they simply file forms, everything should be O.K. We also receive calls from people who got "help" from someone else. Now, they are having trouble with the INS or Embassies. Some problems have become so great there is no longer any way we can help. Other problems take time to solve, causing delays. The basic role of INS, U.S. Embassies and Consulates is to keep unqualified immigrants from entering or remaining in the U.S. Immigration officers will review your filings in detail for errors. When an error is found, your case will be returned for more information or will be rejected. Cases returned will be reviewed for additional errors, and so on. An improperly filed Green Card petition can result in delays and a potential bar to entering the U.S. for up to ten years.
USCIS policies and procedures are not logical or sensible. The same is true for U.S. Embassies and Consulates. They are not to blame. There are hundreds of thousands of Government workers handling immigration cases. It is a huge bureaucracy that is responsible for securing our nation's borders. The policies and procedures used in your case will not always make sense to you. Those who want to argue, only lose. More importantly, the BCIS (known asINS) and Embassies do not care if you "tried" to do the right thing. You must present your case properly or your case will be rejected.
Immigration rules constantly change, even if the forms do not. US Citizenship & Immigration Services (known as INS) and Embassy forms are made to help government employees do their work. Forms may remain the same for years. However, procedures change overnight. Many forms and their instructions have errors or lack needed information. The INS and Embassies are aware of this fact, but do not have the time and resources to improve them. Even so, you must still satisfy all up-to-date immigration policies and procedures regardless of the forms. A mistake at any point in the process can affect your or family member's ability to obtain a Green Card.
Often, the USCIS ( known as INS) and Embassies "misplace" your papers. Though frustrating, this problem is understandable. There are more than a million pieces of paper sent to the USCIS and U.S. Embassies every day. When papers are lost, you will likely not know there is a problem for months or occasionally even a year.
